It is a new object about how to determine an appropriate protection scope for business method patent in our country.Based on the characteristics of business method patent,this paper makes suggestions for China,including the principles and it's application to determine the protection scope,the explanation of the pant claims and the impaction on scope of protection of patent by functional-defined features.
