Unilateral sanctions through an international arbitration lens: procedural and substantive issues

This chapter first aims at stressing and exposing the legal issues that are specific to arbitration related to unilateral sanctions, from a procedural perspective. Secondly, it will offer insights on substantive law questions that come into play when disputes related to unilateral sanctions are submitted to arbitration. The chapter will discuss these two questions through the arbitrability of the dispute, and the impact of unilateral sanctions on the jurisdiction of an arbitral tribunal, the general principles relating to the substantive law applicable in arbitrations relating to unilateral sanctions and the effect of unilateral sanctions on contracts from an arbitration perspective.
