The Application of Traffic Accident Maintenance to Criminal Trial——Comments on the Judicial Explanation NO.33 of Supreme People's Court

Traffic accident responsibility is decided by the causality between behaviour against regulations and traffic accident,and their function in the causality.Therefore,while trying the criminal cases in traffic accident,we should pay attention to these following problems:1.traffic accident responsibility can't be directly thought as a subjective fault of the litigant;2.traffic accident responsibility doesn't involve all the causal force of accident;3.the inferential responsibility of traffic accident can't be regarded as a basis or an evidence of declaring one's guilty.\;
