Fake news, influence on the formation of public opinion and impacts on the legitimacy of public decision

Technological transformations related to Artificial Intelligence (AI) impact administrative law as algorithms process information that leads to a new understanding of reality. AI applied to social networks is not neutral, especially when it comes to the circulation of fake news and the modulation of will, generating impacts that go beyond the segmentation of society. The focus of the analysis is centered on the importance of studying the impact of AI applied to social networks on the formation of will, which will directly have repercussions regarding the exercise of citizenship and, consequently, democracy. The objective is to analyze the use of AI to form public opinion with a focus on the dissipation of fake news and how this process impacts the legitimacy of public administration and its processes. Fake news causes dysfunctionality in Public Administration based on its basic principles: legality, impersonality, morality, publicity and efficiency. The need to regulate the matter is justified based on the effects of disinformation, classified as fatal to democracy: reduction of the population's cognitive capacity, influence on the electoral process, harm to competing political versions and silencing of dissonant voices, impoverishment of debate and multiplicity of worldviews.
