What Criteria for Trademark Infringement shall We Adopt——Confusion theory or distinctiveness theory

Although the confusion theory and the distinctiveness theory can be thought of as the theoretical basis for trademark infringement to a certain extent,they don't provide sufficient protection for trademark owner's benefit.Whereas the trademark function is the existing basis of trademark,the determination for trademark interests should be on the basis which should grasp trademark functions comprehensively.Thus,China's trademark law can provide the general clauses for trademark infringement and must highlight the significance of trademark functions.
