While Patent Trolls, who pursue license royalty or damages by arguing patent infringement against target companies, are prevalent in the U.S., it is not easy to find typical troll activities in Korea except a few quasi-troll cases. It is because the patent market is relatively small and the litigation system is different from the U.S. system. Nevertheless, we expect to see the emergence of Korean patent trolls utilizing unique factors in Korean system such as criminal charges against the infringer as IT business prospers. In addition, some companies would aggressively pursue profit from their patent portfolio by establishing a patent holding company which would function like a patent troll.
