Research on position of weak artificial intelligence in criminal law

The New Generation Artificial Intelligence Development Plan issued by the State Council summarizes the characteristics of artificial intelligence. Since 2017, artificial intelligence has experienced rapid growth. As a social science, law should respond to the changes in the economic base and superstructure. Because there is no strong artificial intelligence at present, the position of weak artificial intelligence in criminal law has greater research value. It is helpful to ensure the comprehensiveness of research by systematically combing the criminal legal risks involving artificial intelligence with the four elements of crime constitution. In the direction of criminal law, it is concluded that artificial intelligence is involved in the object, objective and subjective elements of criminal law, and the accurate position of weak artificial intelligence in criminal law is sorted out.
