A Study on the Social Theory of Law of K. Marx

맑스가 법을 분석하는 이론적 틀은 헤겔의 법철학 비판에서 구상하기 시작한 사적 유물론(historical materialism)이다. 맑스는 국가와 법을 절대정신의 구현으로 보았던 헤겔과 달리, 계급사회에서 국가와 법은 허구적인 권리들을 이상화하고 있는 정치적인 소외의 한 형태로 보았다. 맑스에 의하면, 계급사회에서 국가와 법은 억압적 지배를 강제하는 도구로서 기능한다. 맑스는 사회구성체를 이루는 제 구조들 중에 경제구조에 우월적인 지위를 부여한다. 따라서, 법체계는 정치적 이데올로기적 상부구조와 마찬가지로 경제적 토대로부터 어느 정도의 자율성을 가지고 있으며 경제구조와 상호영향을 받지만, 궁극적으로는 상부구조의 한 층을 이루는 법체계는 경제적 토대에 의해 조건지워진다. 맑스에 의하면 국가와 법은 일반의지의 외양을 띠지만, 그 본질은 계급적대의 산물이며, 계급투쟁의 장이기도 하다. 그러나 자본주의 체제를 전복시키는 사회주의 혁명이후 수립된 프롤레타리아트 독재 국가와 법은 이전단계의 계급사회의 국가와 법과 질적으로 다른 독특한 기능을 수행한다. 프롤레타리아트 독재는 한 계급이 다른 계급을 지배하기 위한 독재가 아니라 ‘지배계급이 된 피지배계급’이 착취를 종식시키고 무계급사회로 이행하기 위한 이행기의 국가이다. 맑스에 따르면, 프로레타리아트 독재를 통해 계급이 소멸되면서 그와 함께 국가도 법도 사멸해간다. 궁극적으로 공산주의 사회에서는 계급억압의 수단으로서 국가와 법은 사라지게 되며, 비로소 국가는 공공 자치정부로 발전하게 되고, 법은 공동체의 진정한 행위규범체계로 발전해간다. 맑스의 법에 대한 분석은 이데올로기 비판도 함축하고 있다. 자본주의 사회에서 법형식은 경제적인 관계에서 불평등한 개인들을 평등한 시민, 즉 권리의 주체로 나타나게 함으로써 계급불평등을 재생산한다.Whereas liberalist legal philosophers have been interested in the issue of legalism and the rule of law, K. Marx was interested in analyzing the ruling ideology in order to transform the capitalist society. Strictly speaking, Marx’s analysis of law can be considered as a ‘social theory of law’ rather than a legal theory in which laws are defined a system of norms. Theoretical framework that Marx adopted to analyze laws is historical materialism. Marx thought that state and laws are a type of political alienation that displays illusionary rights in the class society. Consequently, Marx thought state and laws operate as an instrument that forces class oppression. Marx also emphasized the economic structure over any other structures that are constructing social formation. Thus, Marx argued that legal system, which forms a layer of superstructure, is conditioned and determined by the economic structure, which he called, ‘the foundation of society’. According to Marx, a state or a law is the product of class antagonism even if it takes the appearance of ‘general will’. However, he also thought that proletariate dictatorship as a state will play a unique role in the history, in contrast to any other state in the past class societies. He argued that it will function as the state in transition, which takes the distinct role of abolishing the class exploitation in order to generate a classless society. The state and laws that are instruments of class oppression was expected to disappear(or die) alongside the abolition of class exploitation. Marx’s analysis of law includes ideology critique. He contended that legal form in capitalist society reproduces class inequality as it fabricates equal citizens(legal subjects), thus obfuscating the underlying inequality manifest in economic relations.
