Justifying the public law of patents

Rochelle Cooper Dreyfuss’ vision of patent law as public law offers an additional basis for the legitimation of patent law: institutional legitimation. Institutional legitimation of patent law is based on four models: structural legitimation, regulatory legitimation, discursive legitimation, and governance legitimation. Understanding these four models of legitimation helps to enrich our understanding of patent law as public law.
